1. Ownership & Original Works

All visual art, physical art, digital assets, garment modifications, and original musical compositions explicitly credited to LAC are the exclusive intellectual property of the artist unless otherwise stated in each Surge's description. Unauthorized reproduction, resale, or commercial use is strictly prohibited. The use of I, We, the artist, LAC, Surges, and WAVEES in this document pertains to the artist LAC and her archival works. The use of buyer(s), collector(s), and steward(s) pertains to the intended buyer of its respective Surge.

First Sale Doctrine & Physical Media: Regarding third-party components within a Surge (such as vintage records, VCRs, DVDs, VHS tapes, books, or apparel), LAC invokes the First Sale Doctrine. Any physical items legally acquired—whether through purchase, gift, public institutions, or discovered as abandoned property—are legally redistributed as part of the curated Surge archive.
Transformative Fair Use: LAC’s use of cultural references, movie scenes, and iconic imagery in her performances constitutes Fair Use. These elements are repurposed to create a new artistic meaning distinct from the original source material. LAC claims no ownership of original trademarks or movie copyrights, only the rights to her own transformative creations.
Public and Institutional Artifacts: This also includes free items and materials available to the public at state, federal, financial, and educational institutions. Once these materials are acquired by the artist, they are incorporated into the collective work and redistributed under the protections of the First Sale Doctrine. LAC claims no ownership of the original trademarks of these third-party items, only the right to include and redistribute them as part of her transformative artistic vision.

2. The Surge Global Audio Index (Apple Music®, Spotify®, and Tunemymusic®)

Each Surge is paired with a curated digital experience consisting of 144 songs, part of a larger project archive of 20,736 tracks.

Nature of Curation: This index is a non-commercial, artistic directory. LAC does not host, stream, or transmit these audio files. I provide curated gateways to a licensed third-party service (Apple Music®, Spotify®, Tunemymusic®).
Non-Affiliation: I claim no ownership of the intellectual property, publishing rights, or master recordings of the third-party artists included in this archive. All rights remain with the respective artists and labels.
Safe Harbor~I respect all creators. If you are a rights holder and wish for a specific track to be removed from my curated index, please contact loreesartcreations@gmail.com for immediate delisting.
The Audio Index is available for sharing and download through Apple Music®, Spotify®, and Tunemymusic® that allows for other 3rd party services.

3. Condition of Physical Relics ("As-Is")

The Surge consists of "lived-in" art. By purchasing, you acknowledge the following regarding the physical artifacts:

Used/Artist-Worn Apparel: Clothing and shoes are curated from second-hand sources or have been previously worn by the artist. They are sold in "Fair" condition with visible wear.
Vintage Media: Records are used and may exhibit audible "pops," crackles, or surface scuffs.
Books (Not written by LAC): Are also previously used by the artist, or recycled sources and may appear to tell its own story in the way of its weathering.
Encased Artifacts: Dead bugs, depleted batteries, and coins are housed in specific containers for preservation. These are sold as non-functional, sculptural components.
Perishables: Curated candy is provided for aesthetic purposes only. Consumption is at the buyer's own risk, especially given the potential 90-day shipping window. LAC makes no guarantees regarding freshness, allergen content, or safety for consumption.

4. Rights & Distribution of Manuscripts

Your original work of my creative memoir created for your Surge is another physical component of the Surge archive. It is the exclusive intellectual property of LAC.

Artistic Finish: Depending on the specific Surge, the book may feature hand-distressing, artist notes, or unique "relic" treatments that align with the "Fair Condition" aesthetic of the collection. Translation to your desired language while in production is also available.
Transit Protection: To mitigate the risks of a 90-day shipping window—including port humidity or rough handling—books are sealed in moisture-wicking barriers before being placed in their specific containers within the art crate.
Liability: As with all Surge items, LAC is not liable for minor cosmetic damage to the book (such as bumped corners or spine stress) that may occur during national/international/global transit.
Prior Publication Rights: I, the artist, reserve the right to release digital or print editions of the book (in part or in full) prior to the completion and shipment of the physical Surge. These releases may be used for promotional purposes, community building, or as a tool to locate the designated buyer for a specific Surge.
Limited Buyer Rights: The purchase of a physical Surge bundle grants the buyers ownership of that specific physical copy. It does not grant the buyer "exclusive" rights to the text itself. The artist maintains all rights to reproduce, adapt, or distribute the manuscript in any medium (digital, audio, or print) at any time.

Digital/Print Pre-Releases

By participating in the Surge collective, buyers acknowledge that the literary components of their bundle may be available to the public in digital or "preview" print formats before the physical archive is delivered.

Purpose of Release: These early releases are designed to facilitate the "Discovery" of the buyer and to provide context for their Surge's items and how my history ties into each piece, in depth.
No Refund Basis: The existence of a digital or lower-cost print version of the book does not entitle the Surge collector to a refund or price adjustment.
Spiritual Alignment of your text: The release of digital or print editions of the book prior to the physical Surge is intended as a spiritual beacon to help locate the intended buyer. Accessing the digital or print text does not grant "spiritual ownership" over the physical Surge.

5. Regulatory Compliance

It is the buyer's responsibility to ensure that coins, biological matter (insects), and any other items within the respective Surge can be legally imported into their country. LAC is not responsible for items confiscated, destroyed, or delayed by customs officials. No refunds will be issued for art bundles/archives altered by customs intervention.

6. "Surge" Releases & Fair Access (Anti-Bot Policy)

Bot Disclaimer: The use of automated scripts, "bots," or any software designed to gain an unfair advantage during a release is strictly prohibited.
Order Cancellation: I reserve the sole right to cancel and refund any order that I suspect was placed via automated means or by a "resell bot."
Technical Failures: I am not responsible for site crashes, slow loading times, or cart errors. Placing an item in your cart does not "reserve" it; the sale is only final once full payment is successfully processed.

7. Sales, Payments, and Anonymity

Anonymity: As a buyer or beneficiary, your identity is kept strictly confidential between you and me. I will never publicly disclose your status or identity without your explicit consent.
Taxes & Duties: International and global buyers are responsible for any customs fees, import duties, or local taxes incurred upon delivery.
Final Sale: Due to the limited and archival nature of Surges, all sales are final. However, the artist reserves the right to use photographs and digital captures of each Surge for continued advertisement, future art exhibitions, and global features. Your anonymity remains my utmost priority given the personal nature of the Surges within the WAVEES to come.

8. Limitation of Liability

To the maximum extent permitted by law, LAC shall not be liable for any indirect, incidental, or consequential damages resulting from:

Your use or inability to use the website or any of the 3rd party links or integrations inside the website for language translation and accessibility to those visually impaired.
Data Security: While I take precautions, I am not liable for unauthorized access to your data resulting from external hacking or third-party service breaches.
In the event a buyer‘s or beneficiaries name, signifiers, and/or those associated with individuals happen to be in the Surge info it will be treated as by Divine design for the Surge’s creation. LAC is not held liable for anonymity breach in this case.
A buyer during THEE FOUNDERS ECHELON stage can request for the signs to be removed from the Surge info to protect anonymity.
Beneficiaries opting out of the work will only be pulled from the gifting pool, conversations with the Artist are treated as Divine appointment in her work and is inseparable from Surges.
In the event THEE HIGHEST ECHELON is not activated due to term breaches and the buyer has requested for removal of signs, the Surge will be released back into the global market along with previously removed signs for alignment with designated soul.
LAC is released from all liability of Website use and social media usage by the users. LAC explicitly states to not operate this website or third party music apps while driving or operating machinery. Each Surge is spiritually aligned to its buyers and beneficiaries~ any feelings, emotions, and/or conditions that arise are not the responsibility of the Artist; including but not limited to fears, excitement, spiritual awakenings, transcendence, hypnosis, and medical conditions activated from pre~existing conditions or newly discovered conditions, hypersensitivity, and arousal in the nervous system. LAC operates on a frequency of Divine calling from our Creator and any physical, mental, spiritual, emotional, or economical impact stemming from any Surge release, acquisition, and process is your sole responsibility and soul’s responsibility.
LAC is not held responsible for buyer or beneficiary dissatisfaction in the event of buyers or receivers remorse, disagreement in LAC’s artistic expression, social media content, involvement in any Surge causes, and/or release of buyers/beneficiaries involvement through possible data breaches, verbal or written agreements, and celebratory announcements from buyers/beneficiaries.
LAC is not responsible for buyers actions and/or what they are led to do and create in their life, nor with their extension of artwork that is included in their designed Surge, before and/or after purchasing their Surge. LAC carries no responsibility for the rest of your creation in the art you’re called to make inside your Surge, separate from the other Surge items at are intellectual property of the Artist. LAC is not responsible for what you do with it, yet may offer suggestions, but sole responsibility is yours~LAC does not decide nor state how much you will make from it if you choose to sell it. The Artist will serve as a co~collaborator of your work for providing the foundation. In the spirit of anonymity you may choose not to credit LAC for her side of the work.Any connections made that this was your Surge before/during/after the release of your own creation, LAC is not responsible for breaching the terms/contract between us. You may choose to credit LAC in your work if you so choose. The rest of creative freedom is up to you in your creation.

9. Spiritual Gifts & Single-Buyer Alignment

Each Surge is a singular, spiritually charged archive curated through my unique gifts. These bundles are created for a single, specific buyer within our world.

Non-Transferable Resonance: While many individuals may feel resonance, the physical archive is a singular vessel intended for one specific steward.
Release of Liability: LAC is not held liable for any emotional, spiritual, or psychological distress if a Surge with which you resonate has already been acquired by another party.
The "Sold" Status: Once a Surge is marked as "Sold," its physical alignment is closed. No duplicates will be created. However, the spiritual alignment is open; you may purchase the Surge's book, or spot its history of glory at a future exhibition where proceeds will continue to serve others.

10. Governing Law & Right of Non-Affiliation

These terms are governed by the laws of South Carolina in the United States of America. Any disputes arising from these terms will be handled in the courts of that jurisdiction.

Right of Non-Affiliation: Buyers and Beneficiaries reserve the absolute right to not be affiliated with LAC or the Surge mission. Despite the guaranteed anonymity provided by the artist, a steward or recipient may, at any time, request to be formally removed from a specific Surge’s cause or mission.
Release Protocol: Upon such a request, the steward agrees to release the Surge back to the global market and allow the reallocation of funds to other causes or individuals as the artist sees fit. In this instance, the 24% initiation deposit remains non-refundable, as it represents the artist's labor and the curation of the archive up to that point.

11. All Sales Final

Due to the highly specific, custom, and collective nature of the Surge, all purchases are final.

No Returns or Exchanges: I do not accept returns or exchanges on any items within the Surge bundle, including apparel, shoes, books, artwork, or media.
Condition Acknowledgement: By completing your purchase, you agree that you are acquiring "Fair Condition" vintage and artist-worn artifacts. No refunds will be issued based on the physical wear, fit, or audible quality.
Cancellation Window: Once a Surge has been initiated or the 144-song collective has begun its final processing phase, orders cannot be cancelled.
Damages: As stated in my Shipping Policy, LAC is released from liability once the archive is collected by the carrier.

12. Evolution of the Surge & Reserved Rights

The Surge is a living, evolving collective. By engaging with this site, you acknowledge that the artwork, literary manuscripts, audio archives, and physical bundles are subject to my ongoing creative process and the shifting global landscape.

Artistic Evolution: I reserve the right to modify, expand, or refine any component of a Surge at any time prior to 100% completion.
Operational Shifts: I reserve the right to update shipping protocols, pricing, and spiritual alignment policies without notice. These changes are often necessitated by the evolving nature of the global economy, maritime shipping climates, and the technical requirements of the art process.

13. Beneficiaries & Philanthropic Allocation

A portion of the proceeds from the Surge is dedicated to specific individuals, community causes, or charitable organizations ("Beneficiaries").

Discretionary & Private Selection: The selection of Beneficiaries is at the sole artistic and spiritual discretion of LAC. Beneficiaries are not listed publicly on the website. Their identities remain strictly confidential between the artist and the recipient.
Allocation Timeline: The allocation of funds is processed only after the final 76% balance has fully cleared and the archival shipping window has been initiated.
Beneficiary Right of Refusal: Any named Beneficiary maintains the absolute right to decline their share of the proceeds for any reason.
Reallocation & Pay-it-Forward: In the event of a refusal, the Beneficiary may elect to direct the funds to another individual or organization of their choosing (subject to LAC's final approval) or release the funds back to LAC to be redistributed to other community causes or artist-led initiatives as the artist sees fit.
Non-Contractual Nature: The mention of a specific Beneficiary is a statement of intent, not a binding third-party contract. Buyers do not have the right to dictate or audit the allocation of funds.

14. Priority Fulfillment & Acquisition Protocol

To ensure the artist’s energy is focused on the most aligned stewards, LAC operates on a Priority Fulfillment basis and a three-tiered Acquisition protocol. This section compliments the ACQUISITION tab

A. THEE INITIAL ECHELON

When a Surge aligns I'm elated that you have found the art for your soul's home. I require an email sent to loreesartcreations@gmail.com stating your desire to claim your place in my Enterprise, which Surge you are claiming, and why the cause is important to you. Once received I will review and respond within 24 business days with your access key to complete your booking request.

B. THEE FOUNDERS ECHELON~ The 24% Deposit

To secure your position in the 144-Surge cycle and initiate the curation of your specific archive, a non-refundable deposit of 24% of the total Surge value is required at this Acquisition stage. This deposit covers the immediate costs of curation, archival storage, and the removal of the Surge from the global market. During our call we will discuss our new connection, the beauty of finding each other, what THEE SOUL'S MEETING means, information about your Surge, anonymity and deposit methods. Your deposit is your signature in our contract together, invoice for your Surge will be provided.

B. THEE HIGHEST ECHELON~Final Payment & The 24-Day Window

Once your specific Surge is 100% complete, you will be notified via the contact information provided with a newly generated access key for our session.

The 24-Day Clock: You have twenty-four (24) business days from the initial notification to request our final booking session. We will discuss shipping details, our beautiful work completed, what THEE SOUL'S EXTENSION means, the fulfillment of our contract in these terms, remit the remaining 76% balance.
The Preparedness Mandate: By placing a deposit, the steward acknowledges their responsibility to be financially prepared for the completion notification. Travel, business trips, or temporary lack of connectivity do not pause the 24-day clock.
Authorized Agents: If the steward anticipates being unavailable or "off-grid," they are expected to allocate funds to an authorized user or representative to complete the final booking session and transaction on their behalf.
The Final Warning: If the email remains unanswered and/or with no final booking in THEE HIGHEST ECHELON after eighteen (18) business days, a final warning will be issued via text and email.
Forfeiture: If the booking and/or balance is not cleared by the end of the 24th business day, the Surge will be released back to the global market. The 24% initiation deposit is strictly non-refundable.

C. Limitation of Liability & Succession

In the event of the steward's passing, or any unforeseen life event that renders the steward unable to complete the booking and/or transaction, LAC is released from all liability. The 24% deposit remains non-refundable.

15. Payment Clearance & Shipping Commencement

To maintain the security of the 144-Surge archive, we strictly distinguish between the initiation of payment and the clearance of funds.

Definition of Cleared Funds: A payment is considered "Cleared" only when the artist’s financial institution confirms the total balance is available and irrevocable.
The 24-Day Initiation Rule: To avoid forfeiture of the 24% deposit, the buyer must initiate the remaining 76% payment within twenty-four (24) business days of the completion notification through THEE HIGHEST ECHELON booking.
The Shipping Trigger: The official 30 to 90-day shipping window starts only once the funds have fully cleared into the artist’s account.
In-Person Exceptions: For local, in-person transactions, the Surge will not be handed over until the artist has verified the clearance of the digital transfer or check.
Estate & Liability: LAC is not liable for delays or forfeitures caused by the buyer's inability to clear funds. The 24% deposit remains non-refundable in all instances where the balance fails to clear following the 24-day initiation period.

16. Artistic Sovereignty, Freedom of Speech, and Safety

As the creator of the Surges, LAC operates under the fundamental right to artistic expression and freedom of speech.

Integrated Media & Performance: By engaging with this business, you acknowledge that the artist’s social media content, digital broadcasts, and public commentary are an extension of the Surge archive.
Cultural Reenactment: As part of the Surge experience, the artist reserves the right to reenact, interpret, or pay tribute to scenes from movies and American culture. These performances are transformative works of art intended for commentary, personal expression, and spiritual reflection.
Non-Affiliation with Media: Reenactments do not imply sponsorship, endorsement, or affiliation with the original film studios, actors, or copyright holders. LAC maintains all rights to her specific performances and interpretations within the Surge collective.
Liability for Resonance: LAC is not held liable for "hurt feelings," emotional discomfort, or ideological disagreement resulting from the creative content, reenactments, or associated social media presence. Art is intended to provoke thought, and the buyer accepts the work as the artist is called to create it.
Social & Spiritual Mission: The Surge collective may include social causes, political commentary, or spiritual themes that may not align with the personal views of all viewers or buyers. The inclusion of these themes is an inseparable component of the art itself.
Liability for Resonance: LAC is not held liable for "hurt feelings," emotional discomfort, or ideological disagreement resulting from the creative content of the Surge or its associated social media presence. Art is intended to provoke thought, and the buyer accepts the work as the artist is called to create it.
Zero Tolerance for Threats: Any threats, harassment, or attempts to intimidate the artist due to her mission, her social media content, or the content of her work will not be tolerated.
Legal Recourse: LAC reserves the right to seek legal intervention in the courts of South Carolina or federal jurisdictions for any interference with her physical well-being, mental health, or professional operations.
Finality of Sale: Disagreement with the artist’s stated mission, social media content, or social causes after a deposit or sale has been initiated is not a valid ground for a refund, cancellation, or dispute.
